These Terms and Conditions (“Agreement”) govern the provision of creative storytelling services by Willowroot Consulting LLC (“Consultant”) to its clients (“Client”) through its website and affiliated platforms. By engaging our services or interacting with our content, you agree to abide by the following terms.

Scope of Services
Willowroot Consulting LLC provides narrative marketing content designed to enhance real estate promotional efforts. Services include:

Interviewing homeowners or Clients to gather personal insights

Crafting an original “Homeowner Story” as supplemental marketing material
-
Collaborating with licensed real estate professionals in Oregon, Washington, and Idaho when applicable
These stories evoke emotional connection and illustrate lived experience within a property. They are not substitutes for legal disclosures or factual representations.

Real Estate Marketing & Representation
These terms govern any promotional content produced in partnership with licensed real estate brokerages operating in Oregon, Washington, and Idaho.

1. Purpose & Scope
By accessing, using, or engaging with our services and content, Clients and users agree to the terms described here.

2. Accuracy of Property Information

All property details are deemed reliable but not guaranteed

Descriptive terms (e.g., “charming,” “ideal for entertaining”) express lifestyle appeal, not factual warranties
-
Buyers must independently verify all details such as square footage, upgrades, year built, or other material facts
3. Marketing Language Policy ("Fluffing")
To comply with applicable advertising laws:

Oregon: ORS 696.301 and OAR 863-015-0125
-
Washington: RCW 18.85 and RCW 64.06.020

Idaho: Title 55, Chapter 25 – Property Condition Disclosure Act
Subjective language may be used to enhance presentation, but must not omit or distort material facts. All factual claims require documentation. Marketing content is reviewed for compliance and retained for twelve (12) months.

4. Seller’s Disclosure & Buyer Due Diligence

Oregon: Seller’s Property Disclosure Statement required under ORS 105.464

Washington: Seller Disclosure Statement required under RCW 64.06.020 for residential properties
-
Idaho: Seller must comply with the Property Condition Disclosure Act under Idaho Code 55-2501
Buyers are encouraged to conduct independent inspections and appraisals in all jurisdictions.

5. No Waiver of Legal Protections
Using our marketing materials does not waive consumer protections under state or federal law.

6. Limitation of Liability
Willowroot Consulting LLC shall not be liable for reliance on descriptive language or unverified representations.

7. Governing Law
This Agreement is governed by the laws of the State in which the property is located: Oregon, Washington, or Idaho.

Limitations & Legal Disclaimer

Willowroot Consulting LLC is not a licensed broker, agent, legal advisor, or appraiser

Stories do not guarantee market value, sales, or buyer interest

Property-related facts must be verified by licensed professionals

Consultant is not liable for third-party use or modification of delivered content
AI Usage Policy
Willowroot Consulting LLC may use artificial intelligence (“AI”) tools as creative prompts to enhance storytelling. All AI-assisted content is:

Human-guided, fact-checked, and rooted in the Client’s personal experience

Reviewed and modified by a trained human editor

Compliant with advertising and disclosure laws in Oregon, Washington, and Idaho
AI is not a substitute for professional expertise or licensed disclosures. No standalone AI-generated outputs are delivered. AI tools do not retain or store client data.

Client Responsibilities
Clients agree to:

Provide honest and accurate information during interviews

Review and approve the final story before distribution

Confirm that required disclosures are provided by a licensed agent or broker

Acknowledge that AI is used only to enhance the writer’s voice
-
Approve AI-generated material only after human fact-checking and editing
-
Confirm that all final content reflects true and accurate information in compliance with applicable state laws
Fees & Payment Terms

Rates are defined in each client’s contract

A non-refundable deposit of 50% is required at agreement execution
-
The balance is due upon approval and delivery of the final narrative
-
All payments post-delivery are non-refundable
Ownership & Usage Rights

Willowroot Consulting LLC retains copyright ownership of the Homeowner Story
-
Clients receive a non-exclusive, royalty-free license for real estate marketing use
-
Content may not be altered without written permission
Termination & Cancellation

Either party may terminate the Agreement within two (2) business days before final delivery
-
Initial deposits are non-refundable, even in the case of cancellation

Both parties agree to protect confidential, sensitive, or proprietary information. No disclosures will occur without written authorization specifying scope and recipients.
Acceptance
